Ind. Decisions - Upcoming oral arguments this week and next

- 10:30 AM - Andre Peoples v. State of Indiana - Peoples had two prior felony convictions, one for forgery and one for dealing in cocaine. He then pleaded guilty to a new dealing offense. The Tippecanoe Superior Court sentenced Peoples as an habitual offender under Indiana Code ยง 35-50-2-8(b)(3)(C). The Court of Appeals affirmed in Peoples v. State, 912 N.E.2d 2 (Ind. Ct. App. Aug. 28, 2009), vacated. The Supreme Court has granted a petition to transfer the case, and has assumed jurisdiction over the appeal. [See the ILB summary of the Aug. 28, 2009 COA opinion here.]
