Ind. Decisions - Upcoming oral arguments this week and next
This week's oral arguments before the Supreme Court (week of 12/21/09):
Tuesday, December 22nd
- 9:00 AM - Wayne D. Kubsch v. State of Indiana - The St. Joseph Superior Court denied post-conviction relief with respect to Kubsch's three murder convictions and death sentence. In this appeal, Kubsch argues that judgment should be reversed because the prosecuting attorney should have been recused from the case, the State failed to disclose evidence, the trial prosecutor engaged in misconduct, and Kubsch's trial counsel rendered ineffective assistance.
[ILB - Here is an AP story today that begins: "Attorneys for a man on Indiana's death row say he should receive a third trial in part because the prosecutor had a conflict of interest."
- 10:05 AM - State of Indiana ex rel. ISBA v. United Financial Systems Corporation - The Indiana State Bar Association ("ISBA") brought an original action, pursuant to Indiana Admission and Discipline Rule 24, alleging that United Financial Systems Corporation and others have engaged in the unauthorized practice of law. The Honorable Bruce Embrey was appointed as Commissioner, and Judge Embrey conducted an evidentiary hearing and issued a report. Following supplemental briefing, the Court has scheduled oral argument to address the ISBA's requests that the respondents be required to disgorge fees charged for unauthorized practices and be held responsible for attorney fees incurred by the ISBA.
